1 Introduction

In the Privacy Policy you will find information on how we use the personal data provided by you, how we protect it and what your rights and obligations in this respect are. Our goal is also to duly inform you about matters relevant to the processing of personal data, especially in view of the content of new legislation on personal data protection, including Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC („GDPR”, the General Data Protection Regulation).

3. Personal data and what processing it means:

Personal data means information about an identified or identifiable natural person. Processing of personal data is basically any operation on personal data, whether by automated means or not, such as collection, storage, recording, organisation, modification, consultation, use, disclosure, restriction, erasure or destruction.

4 Purpose of personal data processing:

ROMET Motors Sp. z o.o. processes personal data for different purposes, and depending on the purpose, different methods of collection, legal grounds for processing, use, disclosure and retention periods may apply.

Your personal data may be processed:

  • to perform a Contract, an Agreement or take the necessary steps to conclude a Contract or an Agreement (GDPR, Article 6(1)(b));
  • to conclude an Contract with the Online Store, fulfil orders placed in our Online Stores and pay for products or services purchased in the Online Stores. If your personal data is provided in order to conclude a Contract with the Online Store, the provision of your personal data is a condition for the conclusion of the Contract. Providing personal data in this situation is voluntary, but the consequence of failure to provide the personal data will be the inability to conclude a Contract with the Online Store;
  • by the bank to handle and settle online money transfers made by the customers of the Online Store with the use of payment instruments (legal basis: GDPR, Article 6(1)(f));
  • by the bank to verify the proper performance of the Contracts concluded with the Online Store, in particular ensuring protection of the payers’ interests in connection with their complaints (legal basis: GDPR, Article 6(1)(f));
  • to respond via the contact form available on the Personal Data Controller’s website;
  • to make an appointment and carry out test drives on motorcycles and bicycles;
  • priority booking of motor vehicles;
  • for analytical purposes applicable to product and service selection, and customer satisfaction surveys;
  • for any commercial communication concerning receivables, accounting records, including the issuing of VAT invoices;
  • for archival purposes in the case of a possible need to establish, exercise and secure or defend against claims;
  • for marketing, if you have given your consent, to the extent of the personal data you have provided for this purpose, including information about offers and promotions, publishing the data in marketing content on the Personal Data Controller’s services, in particular in the Controller’s customer database, on the website at www.romet.pl as well as on social media, including Facebook, Instagram, etc., and potentially, in printed publications: catalogues, advertising in trade media, etc.;
  • to transfer your personal data to other entities cooperating with the Personal Data Controller in connection with the execution of purchase orders in the Online Store;
  • to comply with the legal obligations to which the Personal Data Controller is subject under the law (legal basis: GDPR, Article 6(1)(c));
  • to conduct direct marketing of services provided by the Controller through their promotion, advertising and offer on the basis of granted consent (legal basis: GDPR, Article 6(1)(a));
  • for the purpose resulting from legitimate interests pursued by the Personal Data Controller (GDPR, Article 6(1)(f));
  • for internal administrative purposes of the Personal Data Controller, including conducting a management analysis, statistical analyses, market trend surveys and reporting for the Personal Data Controller’s internal needs;
  • for the purpose of informing you about projects organised by the Personal Data Controller;
  • to send a newsletter – if you have given your consent to receive it;
  • for recruitment purposes – if you have sent us your job application;
  • to handle your complaints, settle your warranty claims and return your benefits in the event of withdrawal from a Contract (return of merchandise);
  • to answer your questions (if you have called or written to us with a request for quotation, or if you have asked us to prepare a quotation);
  • for the purposes of communication with you.

5. Sources and categories of the personal data processed:

Your personal data is collected by your voluntary decision, but if you do not consent to the processing of your personal data by us, this may prevent us from providing you with electronic services and prevent you from purchasing in online stores. Based on the data you provide to us via telephone, fax, e-mail, newsletter subscription form or contact form, we process your personal data, such as:

  • first and last name;
  • e-mail address;
  • phone number;
  • residential or delivery address;
  • company details;
  • login name for logging in;
  • data to process complaints and settle warranty claims

If you visit our websites, we automatically collect IT data about your visit, in particular:

  • IP address;
  • type of operating system;
  • browser type.

A mere visit to our website does not require you to provide any other information or personal data.

6 Personal data recipients:

The recipients of your personal data may include:

  • entities providing and maintaining information systems;
  • entities organising and conducting promotional or marketing activities on behalf of the Controller (including, among others, promotional campaigns, mailing, SMS, loyalty programs, advertising agencies);
  • entities processing personal data under personal data processing outsourcing agreements (so-called ‘data processors’);
  • entities providing hosting services to ROMET sp. z o.o.;
  • entities implementing marketing or sales campaigns for ROMET sp. z o.o.;
  • other subcontractors of ROMET sp. z o. o. that provide software delivery services, maintenance services for the software or hardware used by ROMET sp. z o. o., as well as goods suppliers who support us;
  • auditors and statutory auditors, legal advisers;
  • law enforcement authorities, regulatory authorities and other public administration bodies;
  • courier companies carrying out shipments on behalf of the Personal Data Controller in order to deliver goods ordered in the Online Store, dealing with the delivery of ordered goods;
  • banks and payment institutions cooperating with the Online Store in connection with their handling of payments made by you to the Online Stores.

7 ROMET sp. z o.o. does not transfer your personal data to non-EU countries, meaning states outside the European Economic Area.

8 Data retention period:

The time for which we may process personal data depends on the legal basis, which is a legal prerequisite for the processing of personal data by the Personal Data Controller. In the Policies of ROMET sp. z o.o., including data retention policies, we specify that we must never process personal data beyond the period specified in the aforementioned legal bases. Accordingly, you are advised that:

  • in the event that the Personal Data Controller processes personal data on the basis of consent, the processing period lasts until the moment of withdrawal of this consent by the user;
  • in the event that the Personal Data Controller processes personal data on the basis of the legitimate interest of the controller, the processing period lasts until the aforementioned interest ceases (e.g. the period of limitation of civil law claims) or until the moment of objection of the data subject to such further processing - in situations when the data subject has the right to such objection under the law;
  • in the event that the Personal Data Controller processes personal data, because it is necessary due to the applicable law, the periods of data processing for this purpose are defined by this law;
  • in the absence of specific legal or contractual requirements, the basic data retention period for records and other documentary evidence drawn up during the performance of the contract is a maximum of 10 years;
  • if you send us your CV, it will be stored and processed for the purposes of current recruitment for 6 months, and if you agree to participate in future recruitment processes, the data is stored for 1 year;

9 Cookies Policy.

We collect personal data automatically through the use of cookies on our websites. Cookies are small text files that are stored on your computer or mobile device when you use our websites. The purpose of these files is, among other things, to use various functions provided by the website or to confirm that the user has seen certain content on the website. Cookies include those that are necessary for the operation of the websites of ROMET sp. z o.o. Cookies belonging to this category are used to ensure:

  • that the user session is maintained;
  • the status of the user session is saved;
  • authorisation with the use of the logging service;
  • that the information that allows the user to log in anonymously is saved;
  • that the information necessary for the operation of the online cart for online purchases is saved;

Another category of cookies are files that are not necessary to use the websites but which facilitate the use of them. They are used to make it possible to:

  • restore the last page you visited the next time you log in to the website;
  • remember the user’s choice to stop displaying the selected message or to display it a certain number of times;
  • restore the user session;
  • remember the last selected category in the website;
  • check whether saving to cookies functions properly;
  • enable automatic logging in to the product (if the “Remember Me” option is enabled);
  • adjust the content of products to the preferences of users;
  • set the preferred language, currency, font size and other such features to make working with the application easier;
  • restore the last search result in the website;
  • display the most recently browsed products in the online store;
  • display the last selected sorting parameter.
  • ROMET sp. z o.o. also uses the services of third parties, the list of which is constantly changing, and which use cookies for the following purposes:
  • monitoring traffic on our websites;
  • collecting anonymous, aggregated statistics that allow us to understand how users use our website and enable us to continuously improve our products;
  • determining the number of anonymous users of our websites, required to analyse the use of the websites of ROMET sp. z o.o.;
  • controlling how often users are shown the selected content;
  • controlling how often users select a particular service;
  • analysing subscriptions to newsletters;
  • using a communication tool;
  • integration with a social networking site;
  • online payments.
  • As part of its activity, the Personal Data Controller uses the services and tools of the following partners who use cookies on their websites:
  • Google Analytics;
  • Facebook, Instagram;
  • PayU;
  • Otomoto;

At the same time we would also like to inform you that some elements of the websites of ROMET sp. z o.o. are operated by external advertisers who post behavioural advertisements on the websites of ROMET sp. z o.o. Content from external providers may contain cookies from other entities, so it is recommended that the user familiarise himself or herself with the rules around using these cookies for the operation of websites by these external providers.

Most often, your browser settings allow cookies to be stored by default. If you do not agree to these files being stored on your device, you must change your browser settings accordingly. This may include not storing cookies on your device or informing you each time a cookie is stored on your device. You can also delete files from your device every time you visit the website. 10 Cookies and other tracking technologies

When using our websites, cookies are also used to analyse how their users navigate the Internet. However, the data collected with this type of cookies is pseudonymised using technical facilities. Pseudonymised data can no longer be attributed to the identity of a specific user. It is not stored with your other personal data. The following data can be transmitted using this type of cookie:

  • frequency of access to the site;
  • use of the functions available on the website and the online shop;
  • session duration, number of page views, number of unique page views, average time spent on the page, entries, rejection rate, exit percentage, page value (within Google Optimize);
  • browser type;
  • operating system type;
  1. Cookies used for analytical purposes are used to improve the quality of our websites. With the help of analytical cookies, we obtain information on how users use our websites so that we can systematically optimise our offerings. This purpose constitutes a legitimate interest of the Personal Data Controller as construed under GDPR, Article 6(1)(f).
  2. Our websites use the tool Google Tag Manager, a Google Inc. solution for managing website tags via an interface. The Google Tag Manager tool does not use cookies and does not collect or store personal data. The tool initiates other tags, which in turn can collect data. Google Tag Manager does not access this data. If the tool is deactivated at domain or cookie level, the deactivation applies to all tracking tags set by Google Tag Manager.

Our websites use the tool Smartlook ( smartsupp ), a solution designed to log user activity and behaviour on a website, allowing us to improve the quality, usability and more effective support of users (UX) of our Online Store. Smartlook anonymises the user’s IP address.   4. Our websites use cookies designed for data analysis by  Google Analytics. The information generated by the cookie about your use of our websites is transferred to and stored in a Google server in the United States. Whereby Google uses this information on behalf of the operator of the website in order to interpret the use of our offer to compile a report on the activity within this offer and to provide us with other services related to the web and mobile offer and the use of the Internet. As part of this analysis, pseudonymised user profiles may be created. We only use Google Analytics when IP address anonymisation is enabled. The IP address transmitted by the user’s browser is therefore not combined with other Google data.

10 We collect information about the use of the websites by their users and their IP addresses based on the analysis of access logs. We use this information to diagnose problems related to server operation, analyse potential security breaches and manage the website. We also use the IP address for statistical purposes, i.e. to collect and analyse demographic data from visitors to the website (e.g. information about the region from which the connection was made). On the basis of the information obtained in this way, in special cases, aggregated, general statistics are prepared. These usually include information about the popularity of the website. However, these statistics do not contain, as we emphasise, any information allowing the identification of the website user (user’s identity). We also inform you that we may be required to disclose information regarding the IP address of a particular website user at the request of the state authorities authorised to do so under the applicable laws in connection with proceedings conducted by them.

11 The Personal Data Controller ensures the security of personal data through appropriate technical and organisational measures aimed at preventing unlawful processing of data and their accidental loss, destruction and damage. We use the latest technologies and special data protection procedures. We use modern mechanisms for the protection of transferred data, including in particular encryption connections. Your personal data are stored in a database in which technical and organisational measures have been taken to ensure the protection of the processed data in accordance with the requirements set out in the generally applicable legislation on the protection of personal data.

12 Information about your rights:

You have the right to:

  • request access to your personal data;
  • request the rectification of your personal data;
  • request the deletion of your personal data (“the right to be forgotten”);
  • request restriction of the processing of your personal data;
  • object to the processing of your personal data;
  • transfer your personal data;
  • withdraw consent to the processing of your personal data (if such consent has been given).

Moreover, in connection with the processing of your personal data by the Personal Data Controller, you have the right to lodge a complaint with a supervisory authority, i.e. to the President of the Personal Data Protection Office in Poland.
